UBITracer Warranty Information
Your UBITracer device carries a 12-month limited warranty. The device shall be free from defects in materials and workmanship under normal use and service for 12 months by the original purchaser with proof of purchase. Our obligation under this warranty is limited to repairing or replacing, at Our sole option, any such defective products without charge to You for either parts or labor. If the device is repaired or replaced during the warranty period, the warranty period will expire upon the later of the 90th day after repair or replacement or one year from the original date of purchase.
This Limited Warranty does not apply to (1) cosmetic damage, such as scratches and dents: (2) consumable parts, such as batteries and sim cards; (3) damage caused by accident, abuse, misuse, water, fire, or usage not in compliance with the device specifications; (4) damage caused by service performed by anyone who is not Our authorized service provider; (5) damage to a product that has been modified or altered without Our written permission; (6) any usage in violation of the End User Service Agreement and any operating conditions therein, or in contravention of the laws and regulations of any country; (7) any usage in conjunction with accessories, products, or peripheral equipment not expressly approved or provided by Us; or (8) any malfunction resulting from the failure of the user to abide by the guidance contained in the Safety Information at www.ubitracer.com/safety.
EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH HEREIN, WE HEREBY DISCLAIM ALL IMPLIED WARRANTIES WITH REGARD TO THE SERVICES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ACKNOWLEDGE THAT NEITHER US NOR OUR THIRD PARTY PROVIDERS CONTROLS THE TRANSFER OF DATA OVER COMMUNICATIONS FACILITIES, INCLUDING THE INTERNET AND CELLULAR NETWORKS, AND THAT THE SERVICES MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF SUCH COMMUNICATIONS FACILITIES. WE ARE NOT RESPONSIBLE FOR ANY DELAYS, OUTAGES, LACK OF SPECIFIC CELLULAR SERVICES, DELIVERY FAILURES, OR OTHER DAMAGE RESULTING FROM SUCH PROBLEMS. EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE BY US, THE SERVICES ARE PROVIDED TO YOU ON AN "AS IS" BASIS.
ANY BATTERIES AND ANY SIM CARDS PROVIDED WITH THE UBITRACER DEVICE ARE PROVIDED AS IS, AND BATTERIES NOR SIM CARDS ARE, FOR PURPOSES OF THIS WARRANTY, PART OF THE UBITRACER DEVICE. YOU ASSUME THE RISK OF USING ANY ACCESSORY NOT PROVIDED AS PART OF THE UBITRACER DEVICE.
NEITHER PARTY OR ITS THIRD PARTY LICENSORS SHALL BE LIABLE UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY: (A) FOR LOSS OF BUSINESS OR PROFIT; (B) FOR ANY INDIRECT, EXEMPLARY, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, BODILY INJURY OR DEATH; (C) FOR ANY MATTER BEYOND IT'S REASONABLE CONTROL, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE; OR (D) FOR ANY AMOUNTS THAT, TOGETHER WITH AMOUNTS ASSOCIATED WITH ALL OTHER CLAIMS, EXCEED YOUR ACTUAL PURCHASE PRICE OF THE SPECIFIC UBITRACER DEVICE IN QUESTION OR US$50, WHICHEVER IS GREATER.
You agree and acknowledge that Our exclusions and limitations of liability are reasonable in the circumstances and that the price of the UBITracer device would be increased if such exclusions and limitations were not enforceable.
